Registering the Legitimation of a Child
Procedures
- The Father can register the legitimation of a child before the Registrar at a local District Office. The mother of the child and the child must be present upon registration to express their common consent.
- If both mother and child are not present before the District Officer upon registering for legitimation, the Registrar is required to contact them to obtain their approval. If the mother or child does not consent or fail to do so within 60 days, it can be assumed that the legitimation is not approved. If the mother or child is outside Thailand, the period will be extended for 180 days from the date of filing for legitimation registration.
- If the mother or child denies that the person filing for legitimation is the father of the child, the person filing for legitimation registration is required to obtain approval from a court. The court order must be presented before the Registrar upon filing for legitimation registration.
- Within 90 days of receiving notification regarding legitimation, the mother or child can file a request to the Registrar indicating that the person filing for legitimation is not fully or partially qualified to have custody of the child (Civil and Commercial Code 1976, Book 5, Section 1549).
- According to the Khor. Lor. 1 Form, the Registrar will record the information on the Khor. Lor. 11 Form and forward a copy to the Registrar of the Central Registration Office.
There are three possible procedures regarding Child Legitimation as follows
- A request is filed with the local Registrar. No service fee is required.
- A request is filed with a Registrar to register legitimation outside the District Office. A service fee of 200 baht is required (The applicant is required to pay an appropriate fee, or provide transportation to the Registrar).
- There is a one baht fee to register legitimation in a remote area.
